1. Purpose
This Liability Waiver applies to your use of the My Equine Stay website and to any listing, property, facility, horse, animal, service, or activity you find or arrange through it.
2. Inherent risks of equine activities
Horse-related activities involve inherent risks, including unpredictable horse behaviour, kicks, bites, trampling, falls, collisions, fear or panic reactions, transport hazards, hazards from fences, stalls, pastures, and grounds, weather, animal illness or injury, and interactions with other people and animals.
3. Our role
My Equine Stay LLC publishes listings and connects independent users. My Equine Stay LLC does not provide, own, manage, supervise, or control the properties, facilities, horses, services, or activities described in listings. My Equine Stay LLC is not a party to any agreement between users.
4. No inspection or guarantee
My Equine Stay LLC does not inspect, certify, evaluate, or guarantee: the condition of any property or facility; safety; legal or regulatory compliance; the quality of any service; the accuracy of any listing; the qualifications, licences, or insurance of any user; or the health, temperament, or behaviour of any animal.
5. Your responsibility
You are responsible for assessing the risks yourself, inspecting facilities before use, checking qualifications, licences, insurance, and references you need, confirming prices, availability, and terms, complying with applicable laws and safety rules, and making sure you have appropriate insurance.
6. Assumption of risk
By using the website or entering into an agreement with another user, you knowingly and voluntarily accept the risks described in this waiver, including the inherent risks of equine activities.
7. Emergencies
My Equine Stay LLC does not provide medical, veterinary, rescue, emergency transport, or insurance services. In an emergency, contact the appropriate emergency services.
8. Florida Equine Activity Liability Act
Florida Statutes Chapter 773 (sections 773.01 to 773.06) addresses liability for injuries from the inherent risks of equine activities. Where that law applies to an activity, the sponsor or professional must give the warning it requires. Nothing in this waiver removes any protection or obligation that Chapter 773 gives or imposes.
9. Release
To the fullest extent the law allows, you release My Equine Stay LLC, its officers, members, managers, employees, and agents from any claim arising from your use of the website or from any listing, service, or activity connected with it, including injury, death, property damage, animal injury, theft, financial loss, and disputes between users.
10. What this waiver does not cover
This waiver does not release My Equine Stay LLC from liability for intentional misconduct, gross negligence, or any obligation that Florida law does not allow to be waived.
11. Acceptance
When you create an account, you must tick the box "I have read and accept the Liability Waiver," then click to accept. We record the version accepted, the date, the time, and your account. Using the website after that confirms your acceptance.
