1. Acceptance
By creating an account, posting a listing, or buying a subscription, you agree to these Terms, the Privacy Policy and the Liability Waiver. We keep a record of the version you accepted, the date, and your account.
2. Operator
My Equine Stay LLC operates this website. Your contract is only with My Equine Stay LLC.
3. The service
My Equine Stay lets users publish and find listings for stays, properties, barns, pastures, RV sites, and related horse services. My Equine Stay does not own, manage, supervise, or control the properties, services, or activities in listings. My Equine Stay is not a party to any agreement between users.
4. Eligibility
You must be at least 18 years old and able to enter a binding contract.
5. Accounts
You are responsible for your login and for all activity on your account. Tell us immediately at myequinestay@hotmail.com about any unauthorised use.
6. Listings
You are solely responsible for the accuracy of your listings, including photos, descriptions, prices, and availability.
7. No verification
Unless the website clearly states otherwise, My Equine Stay does not verify identity, qualifications, licences, insurance, references, or safety. You must do your own checks before any agreement, trip, stay, or animal care.
8. Subscriptions and prices
A listing requires a subscription. Standard: $59.97 USD for 3 months. Premium: $89.97 USD for 3 months. All prices are in US dollars.
9. Automatic renewal
Each subscription renews automatically every 3 months at the same price until you cancel. The price, the period, and the renewal date are shown before you pay, and you must confirm them. A confirmation email is sent after each purchase and each renewal.
10. How to cancel
Sign in, go to Subscription, and select Cancel. Cancellation takes effect at the end of the period you have already paid. Your listing stays visible until then. Refunds for the current period are not provided, except where Florida law requires them.
11. Failed payment
If a renewal payment is declined, the listing is removed until payment succeeds.
12. Suspension and removal
We may suspend or remove a listing or account that breaks these Terms, is fraudulent, unsafe, or illegal, or when the law requires it.
13. Disputes and arbitration
Any dispute between My Equine Stay LLC and a user, or between users concerning this website, will be resolved by individual, binding arbitration under the Federal Arbitration Act. The arbitration takes place in Florida, in English, before one neutral arbitrator. Each party pays its own costs unless the arbitrator decides otherwise. Claims within the jurisdiction of the Florida small claims court may be brought there instead. Either party may seek urgent interim relief from a court. You may opt out of this arbitration clause by sending written notice to myequinestay@hotmail.com within 30 days of your first purchase or account creation.
14. Class action waiver
To the fullest extent the law allows, you waive any right to take part in a class action, collective action, or representative action against My Equine Stay LLC. Each dispute is resolved individually.
15. Content licence
You keep ownership of the content you publish. You grant My Equine Stay LLC a non-exclusive, worldwide licence to host, display, and reproduce that content as needed to operate the service.
16. Limitation of liability
To the fullest extent the law allows, My Equine Stay LLC is not liable for indirect, incidental, special, or consequential damages, or for losses arising from agreements between users, or from the condition, safety, or legality of properties, services, or animals in listings.
17. Indemnity
You agree to defend, indemnify, and hold harmless My Equine Stay LLC, its officers, members, and staff from claims arising from your use of the website, your listings, or your agreements with other users.
18. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
19. Changes
We may update these Terms. We will notify users of material changes before they take effect.
20. General
If any part of these Terms is found unenforceable, the rest remains in effect.
